Privacy Policy for California Residents

This Privacy Policy for California Residents supplements the information contained in Federal Fingerprinting, Inc.’s general privacy policy and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this Policy.
Information We Collect
We collect information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer, household, or device (“personal information“). Personal information does not include:
- Publicly available information from government records.
- Deidentified or aggregated consumer information.
In particular, we have collected the following categories of personal information from consumers within the last twelve (12) months:

We obtain the categories of personal information listed above from the following categories of sources:
- Directly from you. For example, from forms you complete or products and services you purchase.
Use of Personal Information
We may use, or disclose the personal information we collect for one or more of the following purposes:
- To fulfill or meet the reason you provided the information.
- To create, maintain, customize, and secure your account with us.
- To provide you with support and to respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
- To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
- As described to you when collecting your personal information or as otherwise set forth in the CCPA.
We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.
Sharing Personal Information
We may share your personal information by disclosing it to a third party for a business purpose. We prohibit using the disclosed information for any purpose except performing the business purpose. In the preceding twelve (12) months, the Company has disclosed personal information for a business purpose to the categories of third parties indicated in the chart below.

Personal Information Sales Opt-Out and Opt-In Rights
The CCPA grants California consumers the right to opt-out of the sale of their personal information and the right to opt-in if they are under the age of 16. We want to ensure that you understand these rights and how to exercise them.
- Right to Opt-Out of Sale: You have the right to opt-out of the sale of your personal information to third parties. We do not sell personal information to third parties for monetary gain; however, we may share certain information with service providers and partners for business purposes. If you would like to opt-out of any potential future sale of your personal information, please contact us through one of the following methods:

- Right to Opt-In (Minors under 16): If you are under the age of 16, you or your parent or guardian have the right to opt-in to the sale of your personal information. We do not knowingly sell personal information of individuals under 16 years of age without affirmative authorization. If you are the parent or guardian of a minor under 16 and wish to provide opt-in consent, please contact us using the contact methods listed above.
For your protection, we may need to verify your identity before processing your request. This is to ensure that your personal information is not disclosed to unauthorized individuals.
Please note that even if you opt-out, we may still collect and use your personal information for other purposes, as outlined in our Privacy Policy.
We are committed to respecting your choices and responding to your rights requests in accordance with the CCPA’s requirements. We will respond to your request within 15 business days of receiving it, acknowledging its receipt and providing information about how we will process your request.

Notice of Biometric Policies
Why We Collect
We collect your biometric data, including fingerprints/ fingerprint scans, and other personal information, including date of birth and social security number, in the provision of Live Scan services to individuals and organizations.
Usage of Biometric Data
We use your biometric data and other personal information for the confirmation of your identity and the performance of a background check.
Storage of Biometric Data
Fingerprint images and other biometric data are considered confidential under California law. We take reasonable precautions to protect your biometric data and other personal information from unauthorized access by storing materials containing confidential information in a secure location.
We retain your personal information for a maximum of 10 years. However, fingerprint images and records obtained for Live Scan purposes may not be retained in either electronic or hard copy form for longer than 30 calendar days from the date of the initial transmission of the fingerprint record to the DOJ, pursuant to the California Department of Justice Bureau of Criminal Information and Analysis Terms and Conditions for Private Service Providers in California.

Disclosure of Biometric Data
We transmit such information to employers and governmental agencies, including the U.S. Department of Justice and the Federal Bureau of Investigation, or for other purposes, including the conversion of “wet” fingerprint cards into a digital format for such transmissions. If instructed to do so by a client, we may transmit such information via U.S. Mail or any other courier service such as FedEx, UPS, Federal Express, etc. We do not sell your biometric or other personal data.
Right to Opt Out
You have the right to opt out of the collection of your biometric data. To have your data permanently removed from our system, please contact us by sending an email to info@federalfingerprinting.com with the subject line “Remote Archived, Fingerprints”. The email must come from the email address of the person whose information we have archived. You may also send a physical letter to ATTN: OPT OUT – Federal Fingerprinting – 80 W. Your Rights and Choices
The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.
Right to Know and Data Portability
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (the “right to know”). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will disclose to you:
- The categories of personal information we collected about you.
- The categories of sources for the personal information we collected about you.
- Our business or commercial purpose for collecting or selling that personal information.
- The categories of third parties with whom we share that personal information.

If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
- sales, identifying the personal information categories that each category of recipient purchased; and
- disclosures for a business purpose, identifying the personal information categories that each category of recipient obtained.
- The specific pieces of personal information we collected about you (also called a data portability request).
Right to Delete
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions (the “right to delete”). Once we receive your request and confirm your identity (see Exercising Your Rights to Know or Delete), we will review your request to see if an exception allowing us to retain the information applies. We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:
- Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
- Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
- Debug products to identify and repair errors that impair existing intended functionality.
- Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
- Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).
- Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
- Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
- Comply with a legal obligation.
- Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
We will delete or deidentify personal information not subject to one of these exceptions from our records and will direct our service providers to take similar action.
Exercising Your Rights to Know or Delete

- If you happen to have a password-protected account with us, please contact us directly so that we can delete this account and the password by emailing us or calling us at the information provided above.
Only you, or someone legally authorized to act on your behalf, may make a request to know or delete related to your personal information. To designate an authorized agent, complete the Authorized Agent Designation Form (attached).
You may also make a request to know or delete on behalf of your child by completing the Consumer Request Form(attached).
You may only submit a request to know twice within a 12-month period. Your request to know or delete must:
- Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include: your name, address, email address, and phone number
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
You do not need to create an account with us to submit a request to know or delete. [However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.]
We will only use personal information provided in the request to verify the requestor’s identity or authority to make it.
Personal Information Sales Opt-Out and Opt-In Rights
If you are age 16 or older, you have the right to direct us to not sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers. For instructions on exercising your sale opt-out or opt-in rights, see Personal Information Sales Opt-Out and Opt-In Rights.
Response Timing and Format
We will confirm receipt of your request within ten (10) business days. If you do not receive confirmation within the 10-day timeframe, please contact us at: 888-417-0203 Ext. 2020.
We endeavor to substantively respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to another 45 days), we will inform you of the reason and extension period in writing.
If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.
Any disclosures we provide will only cover the 12-month period preceding our receipt of your request. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance, specifically via CSV spreadsheet or PDF.
We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.
Non-Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
- Deny you goods or services.
- Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
- Provide you a different level or quality of goods or services.
- Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
Changes to Our Privacy Policy
We reserve the right to amend this privacy policy at our discretion and at any time. When we make changes to this privacy policy, we will post the updated notice on the Website and update the notice’s effective date. Your continued use of our Website following the posting of changes constitutes your acceptance of such changes.

Legal Basis for Processing Personal Data under the General Data Protection Regulation (GDPR)
If you are from the European Economic Area (EEA), Federal Fingerprinting, Inc.’s legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.
Federal Fingerprinting, Inc. may process your Personal Data because:

Retention of Data
Federal Fingerprinting, Inc. will retain your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes and enforce our legal agreements and policies.
Federal Fingerprinting, Inc. will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period, except when this data is used to strengthen the security or to improve the functionality of our Service, or we are legally obligated to retain this data for longer periods.
Transfer of Data
Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.
If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there.
Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
Federal Fingerprinting, Inc. will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.
Biometric Information Privacy and Record Retention Policy
Illinois Biometric Information Privacy Act, 740 ILCS Section 14/1 et seq.
Federal Fingerprinting, Inc. has instituted the following biometric information privacy policy:
Biometric Data Defined:
As used in this policy, biometric data includes “biometric identifiers” and “biometric information” as defined in the Illinois Biometric Information Privacy Act, 740 ILCS § 14/1, et seq. “Biometric identifier” means a retina or iris scan, fingerprint, voiceprint, or scan of hand or face geometry. Biometric identifiers do not include writing samples, written signatures, photographs, human biological samples used for valid scientific testing or screening, demographic data, tattoo descriptions, or physical descriptions such as height, weight, hair color, or eye color. Biometric identifiers do not include information captured from a patient in a health care setting or information collected, used, or stored for health care treatment, payment, or operations under the federal Health Insurance Portability and Accountability Act of 1996.
“Biometric information” means any information, regardless of how it is captured, converted, stored, or shared, based on an individual’s biometric identifier used to identify an individual. Biometric information does not include information derived from items or procedures excluded under the definition of biometric identifiers.
Purpose for Collection of Biometric Data:
The Company and its suppliers use biometric data solely for client candidate or employee identification and pre-employment or current screening FBI CJIS fingerprinting compliance purposes for our clients and Company candidates or Federal Fingerprinting, Inc. candidates or employees for which compliance with FBI CJIS fingerprinting is required.
Disclosure and Authorization:
To the extent that the Company or its suppliers capture, convert, store, share, or otherwise obtain biometric data relating to a candidate or employee, based on an individual’s biometric identifier relating to a client’s candidate or employee identification for pre-employment or current screening FBI CJIS fingerprinting compliance purposes for our clients and Company candidates or employees, the Company must first:
Inform the candidate or employee in writing that the Company, its suppliers are collecting, capturing, or otherwise obtaining the employee’s biometric data, and that the Company is providing such biometric data to for internal Federal Fingerprinting, Inc. FBI CJIS Human Resource compliance purposes or its suppliers for candidate or employee FBI CJIS fingerprint background screening purposes;
Inform the candidate or employee in writing of the specific purpose and length of time for which the employee’s biometric data is being collected, stored, and used; and
Receive a written release signed by the candidate or employee (or his or her legally authorized representative) authorizing the Company and its suppliers to collect, store, and use the employee’s biometric data for the specific purposes disclosed by the Company, and for the Company to provide such biometric data to its suppliers.
Federal Fingerprinting, Inc. and its suppliers will not sell, lease, trade, or otherwise profit from employees’ biometric data; provided, however, that the Company’s suppliers may be paid for products or services used by the Company that utilize such biometric data.
Disclosure:
Federal Fingerprinting, Inc. will not disclose or disseminate any biometric data to anyone other than its suppliers of Federal Fingerprinting, Inc. providing fingerprint background screening products and services using biometric data without/unless:
First obtaining written employee consent to such disclosure or dissemination;
The disclosed data completes a financial transaction requested or authorized by the employee;
Disclosure is required by state or federal law or municipal ordinance; or
Disclosure is required pursuant to a valid warrant or subpoena issued by a court of competent jurisdiction.
Retention Schedule:
The Company shall retain employee biometric data only until, and shall request that its suppliers permanently destroy such data when, the first of the following occurs:
The initial purpose for collecting or obtaining such biometric data has been satisfied, such as the fingerprint background screening report has been received by Federal Fingerprinting, Inc. or its client or thirty days have passed pursuant to FBI CJIS Channeling requirements, the termination of the employee’s employment with the Company, or the employee moves to a role within the Company for which the biometric data is not used;
As contracted with the Federal Fingerprinting, Inc. client or within 3 years of the candidate or employee’s last interaction with the Company.
Data Storage:
The Company shall use a reasonable standard of care to store, transmit and protect from disclosure any paper or electronic biometric data collected. Such storage, transmission, and protection from disclosure shall be performed in a manner that is the same as or more protective than the manner in which the Company stores, transmits, and protects from disclosure other confidential and sensitive information, including personal information that can be used to uniquely identify an individual or an individual’s account or property, such as names, fingerprints, employee identification numbers or social security numbers.
Disclosure of Data
Disclosure for Law Enforcement
Under certain circumstances, Federal Fingerprinting, Inc. may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g., a court or a government agency).
Legal Requirements
Federal Fingerprinting, Inc. may disclose your Personal Data in the good faith belief that such action is necessary to:
To comply with a legal obligation
To protect and defend the rights or property of Federal Fingerprinting, Inc.
To prevent or investigate possible wrongdoing in connection with the Service
To protect the personal safety of users of the Service or the public
To protect against legal liability
Security of Data
The security of your data is important to us but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.
Your Data Protection Rights under the General Data Protection Regulation (GDPR)

By accessing or using any services provided by Federal Fingerprinting, Inc. (“Company,” “we,” “us,” or “our”), including but not limited to scheduling an appointment online, booking a mobile on-site fingerprinting service, visiting a walk-in location, or using any of our services in California or any other jurisdiction, you (“Client,” “Customer,” “User,” “you”) acknowledge and agree to the following Terms and Conditions. If you do not agree, do not use our services.
1. AGREEMENT TO TERMS
By using our services, you agree to be bound by these Terms and Conditions. This includes any individuals, entities, or organizations who schedule appointments on behalf of others.
2. NO WARRANTIES AND SERVICES PROVIDED “AS IS”
All services are provided “AS IS” and “AS AVAILABLE” without any warranties, express or implied. We do not guarantee:
* The accuracy, completeness, or acceptance of fingerprinting results by any third party, including government agencies, licensing boards, or employers.
* That our services will be uninterrupted, error-free, or free from defects.
* That results will be timely or meet the specific needs of any individual or organization.
It is solely your responsibility to confirm that our fingerprinting services meet your requirements before scheduling.
3. INDEMNIFICATION AND HOLD HARMLESS CLAUSE
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless Federal Fingerprinting, Inc., its owners, officers, employees, agents, contractors, affiliates, and representatives from and against any and all claims, liabilities, losses, damages, expenses, demands, lawsuits, or legal actions, including attorney’s fees and costs, arising from:
* Your use of our services.
* Any errors, omissions, or delays in processing fingerprints.
* The rejection of your fingerprints by any third party, including government agencies or employers.
* Any technical issues, software malfunctions, or connectivity failures affecting our booking system or fingerprint transmission.
* Any personal injury, property damage, or other harm occurring at any of our locations or while receiving mobile fingerprinting services.
* Your failure to provide accurate or complete information.
* Any acts or omissions of third-party service providers, agencies, or organizations related to the fingerprinting process.
This indemnification applies regardless of the cause, including negligence, misconduct, or errors on our part, except where prohibited by law.
4. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Federal Fingerprinting, Inc. and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:
* Lost wages, employment opportunities, licensing denials, or any other financial or reputational harm.
* Government rejections, processing delays, or fingerprint submission errors.
* Technical failures, website outages, or appointment scheduling errors.
* Personal injuries, property damage, or other losses resulting from the use of our services.
OUR MAXIMUM LIABILITY UNDER ANY CIRCUMSTANCES SHALL NOT EXCEED THE TOTAL AMOUNT PAID FOR THE SERVICES RENDERED.
5. CANCELLATIONS, REFUNDS, AND NO-SHOW POLICY
All appointment bookings are final. Refunds will not be issued for:
* No-shows or late arrivals.
* Fingerprint rejections due to poor quality, worn fingerprints, or failure to follow instructions.
* Services rendered, regardless of the outcome.
* Cancellations made within 48 hours of the appointment.
We reserve the right to refuse service to anyone at our sole discretion.
6. CLIENT RESPONSIBILITIES
You acknowledge and agree to:
* Provide accurate personal information.
* Follow all instructions for fingerprinting, including proper identification.
* Verify the service you require before scheduling, as we are not responsible for incorrect service selection.
Failure to comply may result in service refusal without a refund.
7. THIRD-PARTY REQUIREMENTS AND COMPLIANCE
We do not control or influence the policies of government agencies, licensing boards, or other third parties requiring fingerprinting. We are not liable for any changes in their requirements, processing times, or rejection of fingerprint submissions.
8. FORCE MAJEURE
We are not liable for delays or failures due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, power failures, internet disruptions, or other unforeseen events.
9. GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the courts of [County], California.
10. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and Federal Fingerprinting, Inc., superseding any prior agreements or understandings.
12. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. Your continued use of our services constitutes acceptance of the revised Terms.
BY BOOKING AN APPOINTMENT, WALKING INTO A LOCATION, OR USING ANY OF OUR SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THESE TERMS.
