Why Do I Need a Live Scan?

The California Department of Justice (DOJ) is mandated to maintain the statewide criminal record repository for the State of California. In this capacity, sheriff, police and probation departments, district attorney offices, and courts submit arrest and corresponding disposition information. The DOJ uses this information to compile records of arrest and prosecution, known as “RAP sheets,” for individuals and disseminates the information for law enforcement and regulatory (employment and licensing) purposes. RAP sheets are based upon fingerprint submissions, and therefore positively identified biometrically; a process by which a person’s unique identity is confirmed.

The Purpose of a Live Scan Fingerprint Background Check

In California, Live Scan fingerprinting background checks are essential for maintaining public safety. Federal Level (FBI) Background Checks

If an FBI criminal background check is requested, the fingerprint images collected by our live scan fingerprinting services are forwarded to the FBI to perform a fingerprint-based search of records in the national criminal history database. If the applicant’s fingerprints match fingerprints in the national criminal history database, the FBI sends the DOJ a cumulative RAP sheet that contains criminal history information from any state or federal agency. If there is not a matching disposition for every out-of-state or federal arrest, the DOJ is again mandated by statute to perform the “genuine effort” to obtain the missing disposition information, just as with California arrests that are missing disposition information. Once the “genuine effort” is fulfilled, a DOJ technician must review the updated Rap sheet and prepare the background check response.

What Happens Next?

Once Your Live Scan is done, then what?

The results of background checks are sent to the agency that requested the criminal background check. DOJ technicians are strictly prohibited from discussing an applicant’s criminal record, neither can they provide legal advice or offer any other information related to the fingerprint background check itself. If an adverse employment, licensing, or certification decision is made based on the results of the criminal history background check, the applicant agency must provide a copy of those results to the applicant immediately.

If your Requesting Job, School, Work or Agency does not have results yet and the digital Live Scan fingerprints were submitted, then you can use the DOJ Website to check on the status of your fingerprint submission. You will need the following information: (#1) your date of birth; (#2) your 10-digit ATI Number (Automated Transaction Identifier) that appears at the bottom of the Department of Justice – Request For Live Scan Form for background checks. The ATI number always appears in the following sequence: 1 LETTER; 3 NUMBERS; 3 LETTERS and 3 NUMBERS
